The rights and obligations of natural gas consumers are established by the Law of Ukraine “On the Natural Gas Market” and the Rules for the Supply of Natural Gas, approved by the Resolution of the National Commission for the Regulation of the National Energy and Power Sector of Ukraine No. 2496 dated 30.09.2015, registered with the Ministry of Justice of Ukraine on 06.11.2015 under No. 1382/27827:
A consumer who is not a household has the right, in particular, to:
1) free choice of supplier;
2) free change of supplier, except for cases provided for in paragraphs
other parts of the first article 14 of the Law of Ukraine “On the Natural Gas Market”;
3) receipt information on general terms of supply (including prices), rights and obligations of the supplier and consumer, indication of legislative acts regulating relations between the supplier and the consumer, available methods of pre-trial resolution of disputes with the supplier;
4) receipt of natural gas of appropriate quality and quantity, the physico-chemical indicators of which comply with established standards, in accordance with the terms of the concluded contracts, except for cases of termination (restriction) of natural gas supply in accordance with the requirements of the law and the terms of the contracts;
5) free receipt of information on volumes and other indicators of own natural gas consumption;
6) early termination of the supply contract, if the supplier has notified the consumer of the intention to make changes to the supply contract in part of the supply conditions and new supply conditions were unacceptable to him;
7) to simultaneously conclude several natural gas supply contracts,
if his annual natural gas consumption exceeds 30 million cubic meters. meters;
8) to receive free information on the supplier's prices for natural gas and the payment procedure;
9) to independently stop (limit) the withdrawal of natural gas for one's own needs in compliance with the requirements of current legislation, of which he must notify in writing all natural gas market entities with which the relevant contracts have been concluded;
10) to demand the resumption of natural gas supply in accordance with the established procedure after eliminating violations and compensating for the payment of services for disconnection and connection, if the termination of gas supply occurred without terminating the natural gas supply contract;
other rights provided for by current legislation.
A consumer who is not an household is obliged, in particular:
1) to conclude a contract for the supply of natural gas;
2) to ensure timely and full payment for the cost of natural gas in accordance with the terms of the supply contract;
3) prevent unauthorized withdrawal of natural gas;
4) ensure unhindered access of authorized representatives of the gas transportation system operator, gas distribution system operator to natural gas metering points and for the purpose of installing gas metering points;
5) terminate (limit) consumption of natural gas in accordance with the requirements of the legislation and the terms of the contracts;
6) ensure compliance with the discipline of selection (consumption) of natural gas in the volumes and on the terms specified in the contracts;
7) implement a set of measures aimed at preventing the emergence of a threat to life or injury, damage to equipment and products, negative environmental consequences, etc. in the event of receiving a notification of termination (limitation) of supply (distribution/transportation) of natural gas;
8) independently limit (stop) the consumption of natural gas in cases of:
- violation of payment terms under a contract for the supply of natural gas;
- absence or insufficiency of the confirmed volume of natural gas allocated to the consumer;
- excess consumption of the daily norm and/or monthly confirmed volume of natural gas without agreement with the supplier;
- absence of a concluded contract for the supply of natural gas;
9) in case of violation or failure to fulfill their obligations, the consumer shall be liable in accordance with the law.
