In the case of natural gas supply to non-domestic consumers, the rights and obligations of the natural gas supplier are established in accordance with Section 11 of the Rules for the Supply of Natural Gas approved by the Resolution of the National Commission for the Regulation of the National Energy and Power Sector of Ukraine No. 2496 dated 30.09.2015, registered with the Ministry of Justice of Ukraine on 06.11.2015 under No. 1382/27827:
The rights of the supplier:
1) to conclude a natural gas supply agreement with any consumer and, in the absence of overdue debts of the consumer for natural gas to the current supplier, to supply natural gas to the consumer in period following the period of natural gas supply by the incumbent supplier;
2) to receive timely payment for natural gas from the consumer in accordance with the terms of the contract;
3) to have unhindered access (upon presentation of an official ID) to commercial natural gas metering units installed at the consumer's consumption facilities to verify data on actual natural gas consumption;
4) to receive complete and reliable information from the consumer with whom the supply contract has been concluded regarding the natural gas consumption regimes;
5) to initiate the procedure for terminating (limiting) the supply of natural gas to the consumer in accordance with the terms of the contract for the supply of natural gas and in accordance with the requirements of the Supply Rules;
6) other rights provided for by these Rules and the current legislation.
Obligations of the supplier:
1) comply with the requirements of the Supply Rules;
2) ensure the supply of natural gas on the terms and in the volumes specified in the contract for the supply of natural gas, provided that the consumer complies with the discipline of natural gas selection and payments for it;
3) ensure the submission of all necessary documents for confirmation by the GTS Operator of the volume of natural gas required by the consumer, provided that the consumer has fulfilled his obligations to the supplier to order the volume of natural gas required by the consumer;
4) in accordance with the established procedure, consider requests from consumers regarding activities related to the supply of natural gas;
5) timely provide the consumer with reliable information, including that provided for by the Law of Ukraine "On the Features of Access to Information in the Spheres of Supply electricity, natural gas, heat supply, centralized hot water supply, centralized drinking water supply and water disposal", as well as data on actual charges (volume and cost) for gas supply services, in order to enable the consumer to regulate his own natural gas consumption. Measures for providing information to the consumer must be provided for in the natural gas supply contract. No additional costs for providing information shall be paid by the consumer;
6) notify the consumer in a timely manner if the supplier is in the process of liquidation or bankruptcy, or the supplier is undergoing the procedure of suspension/cancellation of the license for the supply of natural gas, or its license for the supply of natural gas has been canceled, or the activity has been stopped and about the absence of a natural gas resource;
7) comply with minimum standards and requirements for the quality of service for natural gas consumers;
8) offer the consumer under the natural gas supply contract a choice of payment methods for the natural gas supplied and consumed, including a bank payment service, online transfer, postal order, cash deposits to the supplier's account at the cash desk and/or other methods, the approval of which must be fair, transparent and non-discriminatory among consumers;
9) establish contact points to provide information to consumers. The contact details and operating hours of each contact point must be provided in the natural gas supply contract and on the supplier's website on the Internet;
10) provide the consumer with a final bill (invoice) after a change of supplier or termination of the natural gas supply contract no later than six weeks after such change or termination of the contract;
11) notify the consumer of the intention to change the terms of the natural gas supply contract, while the consumer must be notified of his right to refuse the proposed changes. Such notification must be provided to the consumer no later than 30 days before the planned entry into force of such changes (except for the price of natural gas, if it is established for the supplier by the relevant state authorities);
12) perform other duties stipulated by current legislation.
